General Terms and Conditions of Sale

1. Scope and acceptance

These General Terms and Conditions of Sale (the “Terms”) apply to consumer purchases made through https://thetodayproject.net from LAB NOMA S.L., trading as The Today Project.

Before placing an order, the customer must be given a clear opportunity to read and accept these Terms. The Terms applicable to an order are those in force when the order is placed. They must be capable of being stored and reproduced by the customer and should be included or linked in the order-confirmation email in a durable format.

Bespoke hotel, wholesale, distributor, professional or business-to-business orders may be governed by a separate quotation, contract or set of commercial terms. Mandatory rights applicable to consumers are not waived or restricted by these Terms.

3. Eligibility and contracting language

Customers must be at least 18 years old and have legal capacity to contract. The online shop is intended for purchases by individual consumers. Hotel, wholesale and other professional orders must be arranged separately and may be governed by separate commercial terms.

The contract may be concluded in English, Spanish or German, according to the language selected on the Website. Mandatory pre-contractual information for consumers in Spain will be available at least in Spanish.

4. Products and product information

The Website will display the essential characteristics, net quantity, price and, where applicable, use instructions, ingredients, precautions and other mandatory information for each product. Customers should read the product page and product label before use.

Product photographs and colours are intended to represent the products as accurately as reasonably possible, but display settings and the handmade or natural characteristics of certain items may cause minor variations that do not affect conformity.

The products are intended for the uses stated on their packaging and product pages. Individual sensitivities or preferences do not, by themselves, mean that a product is defective. This does not affect statutory rights where a product is unsafe, damaged, incorrectly supplied or otherwise not in conformity with the contract.

5. Prices and promotions

Prices are shown in euros and include VAT where applicable, unless the customer’s destination requires a different tax treatment. Delivery charges and any other applicable costs will be displayed before the customer submits the order.

Where a price reduction is announced, the Website will display the legally required prior price together with the reduced price. The prior price will be determined in accordance with the rules applicable at the time of the promotion, including the relevant reference period.

Promotional codes, gifts, samples and free-shipping thresholds are subject to the conditions stated with the relevant promotion. Unless expressly stated otherwise, promotions cannot be combined and have no cash value.

Prices and promotions may change, but changes will not affect orders already confirmed.

6. Ordering process and correction of errors

The customer selects products, adds them to the cart, reviews quantities and prices, provides delivery and billing information, selects a payment method and is shown the final total before placing the order. The customer may correct input errors and modify the cart before submitting the order.

The final order button must clearly indicate that submitting the order entails an obligation to pay, using wording such as “Order and pay” or an equivalent unambiguous expression.

After submission, LAB NOMA S.L. will send an electronic acknowledgement without undue delay and, in any event, within the legally required period. This automatic acknowledgement confirms receipt but does not yet constitute acceptance. The contract is concluded when LAB NOMA S.L. begins preparing the order and communicates its acceptance or preparation status to the customer by email.

If the customer identifies an error after placing the order, they should contact noma@labnoma.com as soon as possible. Changes cannot be guaranteed once preparation or dispatch has begun.

7. Availability and refusal or cancellation of orders

Orders are subject to availability. If a product becomes unavailable after payment, LAB NOMA S.L. will inform the customer and refund the amount paid for the unavailable product without undue delay.

LAB NOMA S.L. may refuse or cancel an order for legitimate reasons, including an obvious pricing or product-description error, suspected fraud, payment failure, delivery impossibility, unlawful resale activity or lack of stock. If payment has already been collected and the order is cancelled, the corresponding amount will be refunded, without prejudice to the customer’s mandatory rights.

8. Payment

Available payment methods are displayed at checkout and include credit or debit card, PayPal, Apple Pay, Google Pay and Klarna. Stripe processes card and compatible wallet payments; PayPal and Klarna process their respective methods. Payment data is entered directly into the relevant payment provider’s secure environment. LAB NOMA S.L. does not store full card numbers or security codes.

Payments may be subject to authentication under applicable payment-services rules. The customer confirms that they are authorised to use the selected payment method.

9. Delivery

The Website accepts orders for mainland Spain, the Balearic Islands, the Canary Islands, Ceuta, Melilla, European Union destinations, the United Kingdom and the United States, subject to the options available at checkout.

Standard delivery is free for qualifying orders of EUR 70 or more in Spain and EUR 220 or more in other European destinations, subject to the exclusions and conditions displayed at checkout. For deliveries to the Canary Islands, the customer bears the transport charge shown before purchase, while LAB NOMA S.L. bears the applicable taxes, customs duties and customs-management costs. The free-delivery thresholds do not apply to the Canary Islands unless expressly stated otherwise at checkout.

Orders may be delivered by Correos Express, GLS, DHL, UPS or MRW, depending on the destination, availability and service selected.

Delivery charges and estimated delivery times are displayed before the order is submitted. Any advertised free-delivery threshold applies only under the conditions and destinations stated on the Website.

Unless another delivery period has been expressly agreed, goods will be delivered without undue delay and no later than 30 calendar days after conclusion of the contract. If LAB NOMA S.L. cannot meet the agreed date, the customer will be informed and may agree a new date or exercise the rights provided by applicable law.

For destinations outside the EU VAT territory or customs union other than the Canary Islands, responsibility for import taxes, local duties and customs-clearance charges will be shown clearly before purchase where these amounts can be determined. The customer may be responsible for such charges where expressly disclosed and permitted by law. LAB NOMA S.L. is not responsible for customs delays outside its reasonable control.

Delivery is completed when the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods. Risk passes at that time, except where the customer independently commissions a carrier not offered by LAB NOMA S.L., in which case mandatory law will apply.

10. Failed delivery and incorrect address

The customer is responsible for providing a complete and accurate delivery address. If delivery fails, the carrier or LAB NOMA S.L. will provide available instructions for redelivery, collection or return.

Where an order is returned because of an incorrect address, unjustified refusal or repeated failed delivery attributable to the customer, LAB NOMA S.L. may deduct or request the reasonable direct cost of a new shipment or return, where permitted by law and after informing the customer. This does not affect rights where delivery failed for reasons attributable to LAB NOMA S.L. or the carrier selected by it.

11. Right of withdrawal

Consumers have 14 calendar days to withdraw from an online purchase without giving a reason. The period runs from the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods. For a single order delivered separately, it runs from receipt of the last item.

To exercise this right, the consumer must send an unequivocal statement before the deadline to:

The consumer may use the model withdrawal form at the end of these Terms, but its use is not mandatory.

After receiving the withdrawal notice, LAB NOMA S.L. will confirm the operational return address and return instructions. Goods must be returned to the address indicated in those instructions without undue delay and no later than 14 calendar days after communicating withdrawal. The consumer bears the direct cost of return. No printed invoice may be made an absolute condition for exercising a statutory right where the purchase can be identified by other reasonable means.

LAB NOMA S.L. will refund payments received, including the cost of the least expensive standard delivery method offered, no later than 14 calendar days after being informed of the withdrawal. The refund may be withheld until the goods are received or the consumer supplies evidence of return, whichever occurs first. The refund will be made using the original payment method unless otherwise expressly agreed and without fees for the consumer.

The consumer is responsible only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

12. Exceptions to withdrawal

The right of withdrawal does not apply, among other legally recognised cases, to:

  • goods made to the consumer’s specifications or clearly personalised;

  • goods liable to deteriorate or expire rapidly;

  • sealed goods that are not suitable for return for health-protection or hygiene reasons and that were unsealed after delivery; and

  • goods that, after delivery and because of their nature, have become inseparably mixed with other goods.

The hygiene exception is applied only where the product was supplied with an effective, tamper-evident seal and, once unsealed, is genuinely unsuitable for return for health or hygiene reasons. Ordinary product packaging that does not function as an effective seal is not treated automatically as a hygiene seal. Where no effective seal exists, opening the packaging does not by itself remove the right of withdrawal, although the consumer may be responsible for diminished value caused by handling or use beyond what is necessary to establish the product’s nature, characteristics and functioning. This exception concerns withdrawal only and never removes statutory rights if a product is defective or not in conformity.

13. Statutory conformity rights and defective products

LAB NOMA S.L. is responsible for a lack of conformity that exists at delivery and becomes apparent within three years of delivery, subject to the rules and presumptions established by applicable consumer law and to the nature and expected useful life of the product.

If a product arrives damaged, incorrect, unsafe or otherwise not in conformity, the customer should contact noma@labnoma.com with the order number and a description of the issue. Photographs may be requested where reasonably useful, but they will not be imposed where inappropriate or impossible.

The consumer is entitled to the remedies established by law, which may include bringing the product into conformity through repair or replacement and, where legally applicable, a price reduction or termination of the contract. For cosmetics, fragrances and similar consumable products, LAB NOMA S.L. will normally offer replacement where a product is damaged, incorrect, unsafe or otherwise not in conformity. Where replacement is impossible, disproportionate or not completed as required by law, the consumer retains any right to a price reduction or termination and refund provided by mandatory law. Remedies will be provided free of charge where required by law, including necessary shipping costs.

Opening or using a cosmetic product does not automatically remove statutory conformity rights. However, normal consumption, misuse, failure to follow instructions, damage caused after delivery or expiry following normal passage of time is not a lack of conformity attributable to LAB NOMA S.L.

14. Returns outside statutory rights

LAB NOMA S.L. does not offer a voluntary return period beyond the statutory right of withdrawal. This does not restrict the statutory withdrawal and conformity rights described in these Terms.

15. Electronic communications and invoices

Order confirmations, invoices and contractual communications may be provided electronically in a durable format. Customers may request a paper invoice where applicable by contacting customer service. This does not affect mandatory rights.

16. Complaints and customer service

Questions, incidents and complaints may be submitted to noma@labnoma.com, by WhatsApp at +34 951 328 485, through the Website contact form or by writing to the registered-office address.

Official consumer complaint forms are available where required. Consumers may also seek assistance from the competent municipal or regional consumer-information service.

The former European Commission Online Dispute Resolution (ODR) platform has been discontinued and is therefore not included in these Terms. If a complaint cannot be resolved directly, the consumer may seek assistance from the competent public consumer-information service. LAB NOMA S.L. will provide information about an appropriate accredited alternative dispute-resolution entity whenever participation or disclosure is required by applicable law.

17. Personal data

Personal data used for orders, payments, delivery, returns and customer service is processed as described in the Privacy Policy. Cookies and similar technologies are described in the Cookie Policy.

18. Accessibility

LAB NOMA S.L. currently qualifies as a microenterprise providing services for the purposes of the exemption in Spanish Law 11/2023, based on its current workforce and financial thresholds. It is therefore exempt from the service-provider accessibility requirements applicable to e-commerce services under that Law for as long as it continues to meet the statutory microenterprise criteria. LAB NOMA S.L. nevertheless seeks to make the Website clear and usable and will review this position if its workforce or financial figures exceed the legal thresholds.

19. Severability and non-waiver

If any provision is held invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

20. Applicable law and jurisdiction

These Terms are governed by Spanish law, without depriving consumers resident in another country of mandatory protections available under the law applicable to them.

Disputes involving consumers will be submitted to the courts determined by mandatory consumer and procedural law, ordinarily those of the consumer’s domicile. For customers acting in a business or professional capacity, and where legally permitted, the parties submit to the courts of Barcelona, Spain.
